Delaware: The 22nd US State to Legalise Cannabis

Delaware has become the 22nd US state to legalise cannabis for adult use, marking a significant shift in the country's cannabis policy. This move comes after the state's governor, John Carney, paved the way for two legislative bills.

John Carney's Change of Heart

Democratic Governor John Carney had previously opposed two bills related to the legalisation of cannabis. However, in April 2023, he acknowledged that there were bigger issues facing the population of Delaware. He stated that the laws could come into effect without his signature, allowing for the lifting of state-imposed penalties for marijuana possession and the establishment of rules for a regulated market.

First Legislative Bill: Decriminalisation

The first legislative bill came into effect last Sunday, ending the prosecution and civil penalties for the possession of cannabis flowers and other products for personal use, including marijuana utensils, for individuals aged 21 and over. Now, possession of up to an ounce of cannabis flowers, up to 12 grams of concentrates or edibles containing 750 milligrams or less THC is legal in Delaware. Penalties for marijuana-related offences for individuals under 21 have also been reduced to a civil fine.

Second Legislative Bill: Regulating Trade

The second legislative bill introduces and regulates a licensing system for the production and retail of marijuana. It provides for the issuance of up to 30 retail marijuana licenses, 30 manufacturing licenses, 60 cultivation licenses, and five testing station licenses. This law came into effect last Thursday.

Activists Celebrate Legalisation

Activists who contributed to the legalisation of cannabis in Delaware are delighted that their years of lobbying, collaboration, and grassroots organisation have resulted in legalisation in their state. Laura Sharer of NORML stated that this victory was the result of the tireless work of thousands of volunteers, dozens of lawmakers, and the support of a large majority of the Delaware community who recognised the need for sensible cannabis policy reform.

Carney's Personal Stance

Despite the legalisation, Governor John Carney is personally still against the implementation of cannabis liberalisation. However, he also stated that too much time had already been spent on this discussion.
