Germany Navigates Through Cannabis Legalization Hurdles

Germany's journey towards the legalization of cannabis, a substance that has long been under scrutiny and subject to stringent regulations, has recently witnessed a significant milestone.

Despite the staunch opposition and attempts to derail the legalization process within the Federal Council, the measure has successfully navigated through, marking a pivotal moment in the nation's cannabis policy evolution.

Opposition’s Attempt to Stall Legalization

The Federal Council, known as the Bundesrat, plays a crucial role in the legislative process of Germany, especially in the context of cannabis modernization efforts.

Opponents within the council made no secret of their intentions to obstruct the legalization process at every possible juncture. A motion was filed by Bavaria’s representative in a bid to stall the measure, aiming to disrupt the momentum that the cannabis legalization movement has been gaining both within and outside Germany.

Amendments and Rejections

While the motion to stall was ultimately rejected, the council did agree upon certain aspects, particularly regarding the role of individual states in managing the administrative costs to implement and enforce national legalization.

A total of 81 recommended amendments were adopted by the chamber, which will now proceed to the Federal Cabinet for further consideration and response.

The Significance of the Procedural Step

Although the battle for cannabis legalization in Germany is far from over, the recent developments signify a major procedural advancement that is worthy of acknowledgment and cautious celebration.

Various criticisms and concerns were addressed during the proceedings, with a total of 81 points of criticism regarding the planned CanG finding a majority in the Federal Council’s specialist committees. These included numerous points that called for a tightening of the law.

The CSU, a party known for its radical anti-cannabis stance, failed to have the motion voted on again so that the Federal Council fundamentally rejects the law completely. The demand to declare the law requiring approval also did not find a majority, and several other repressive requests were rejected.

Cannabis has been a topic of heated debate in Bavaria, where the CSU has positioned itself as a major opponent of cannabis reform. The Bavarian government, under the leadership of the CSU, has expressed its intention to combat cannabis consumption with a central control unit if the law passes despite Bavaria’s resistance.

This anti-cannabis authority would also be responsible for applications from cannabis social clubs. Meanwhile, party leader Söder is engaged in a dialogue with Free Voters leader Aiwanger, discussing the arguments against cannabis legalization amidst the ongoing Oktoberfest celebrations.
